CalmMoney Terms of Service & EULA

Effective date: June 10, 2026

These Terms govern your use of the CalmMoney mobile application and related services ("the Service"), operated by Zihnova ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

This agreement is between you and us — not between you and Apple Inc. or Google LLC (see section 12).

1. The Service

CalmMoney is a budget-planning app: you record transactions, set budgets and savings goals, and optionally share "Budget Spaces" with a partner, family, or group. CalmMoney works only with data you enter yourself — it does not connect to banks or financial institutions.

2. Your account

• You must be at least 13 years old (or the higher minimum age in your jurisdiction) to use the Service.
• Authentication is provided by Clerk. You are responsible for keeping your sign-in method secure and for all activity under your account.
• You agree to provide accurate account information and to use the Service only for personal, non-commercial budgeting.

3. Subscriptions (CalmMoney Premium)

• CalmMoney offers an optional auto-renewing subscription ("Premium"): $4.99/month or $39.99/year, which unlocks features such as multiple Budget Spaces, more than two members per space, unlimited transaction history, advanced analytics, and unlimited receipts.
• Free trial. New subscribers may receive a 14-day free trial. If you do not cancel before the trial ends, the subscription begins and you are charged.
• Billing and renewal. Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Renewal is charged within 24 hours before the period ends, at the price shown at purchase (or as updated with notice per store rules).
• Cancelling. Manage or cancel in your device's store account settings (App Store → Subscriptions, or Google Play → Subscriptions). Deleting the app does not cancel a subscription.
• Refunds are handled by Apple or Google under their own policies; we cannot issue refunds for purchases made through the stores.
• Free tier. The free tier and its limits (e.g. one space, two members, 13 months of in-app history) may change over time. Exporting your data is always free regardless of tier.

4. Your content

• You keep all rights to the data you enter (transactions, budgets, notes, receipt photos). You grant us a limited license to store, process, and transmit it solely to operate the Service — including showing it to the other members of shared spaces you put it in.
• You are responsible for the content you add. Do not upload content that is unlawful or that you have no right to share.

5. Shared Budget Spaces

• Content you add to a shared space is visible to that space's members. Roles (owner, admin, member, viewer) control who can change what.
• If you leave a space, content you contributed stays in the space, disassociated from your identity, so the group's records remain intact.
• If you own a shared space and delete your account, the entire space and all data in it is permanently deleted for every member. Make sure your group is prepared before doing this.
• Space invitations are for people you know. Do not use invitations to spam.

6. Acceptable use

You agree not to: misuse, probe, or disrupt the Service; attempt to access other users' data; reverse-engineer the app except where the law permits; resell the Service; or use it for unlawful purposes. We may suspend or terminate accounts that violate these Terms.

7. Not financial advice

CalmMoney is a record-keeping and planning tool. Nothing in the Service — including analytics, insights, trends, or projections — is financial, investment, tax, or legal advice. Verify important figures yourself; you are solely responsible for your financial decisions.

8. Intellectual property

The app, its design, and its code are owned by us or our licensors and are protected by law. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for personal use, in accordance with these Terms and the applicable store's usage rules.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We recommend exporting your data periodically (it's free — Settings → Data).

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Termination

You may stop using the Service and delete your account at any time (Settings → Delete Account, or zihnova.com/calmmoney/delete-account). We may suspend or terminate the Service or your account for violation of these Terms, or discontinue the Service with reasonable notice. Sections 4, and 7–10 survive termination.

12. App-store terms (Apple & Google)

If you obtained the app from the Apple App Store, the following applies (and the equivalent for Google Play):

• These Terms are between you and us only; Apple is not a party and has no responsibility for the app or its content.
• The license is limited to use on Apple-branded devices you own or control, per the App Store Terms of Service usage rules.
• We, not Apple, are responsible for maintenance, support, warranty claims, product claims (including legal/regulatory claims), and third-party IP claims related to the app. In the event of a failure to conform to a warranty, you may notify Apple and Apple will refund the purchase price; Apple has no other warranty obligation.
• You represent that you are not located in an embargoed country and are not on any restricted-parties list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced in the app or by email before taking effect; continued use after that constitutes acceptance.

14. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-law rules, and disputes are subject to the courts of that jurisdiction — except where the consumer-protection law of your country of residence grants you non-waivable rights or venue.
